If there’s one golden rule when buying property in Italy, it’s this: never rely on just one opinion, especially when it comes from the estate agent selling the home.
Even when an agent seems genuine and helpful (and many are), remember that their primary goal is to complete the sale. That doesn’t always mean they’re trying to mislead you, but sometimes, important details can be overlooked or misunderstood. And when you’re investing in property abroad, those details matter more than you might think.
Always Verify Planning Permissions
One of the most common misunderstandings involves planning permission, especially when it comes to swimming pools.
If an agent says the property already has planning permission for a pool, don’t take it at face value. Ask for a copy of the official documentation and have it reviewed by an independent geometra and lawyer. They can confirm whether the permits are real, current, and valid for the type of pool you intend to build.
If you’re told that obtaining new permission “won’t be a problem,” take that as your cue to double-check. Ask an independent geometra to review the PPTR (Piano Paesaggistico Territoriale Regionale) the regional plan that determines what can and can’t be built on certain types of land. Some plots, especially in rural or protected areas, may have strict limits that prevent pool construction altogether.
Don’t Assume “Key-in-Hand” Means Everything’s Covered
Another common situation is the “chiavi in mano” or key-in-hand offer. This often sounds like a complete, ready-to-move-in package, sometimes including a swimming pool.
Before assuming the pool is included, ask to see detailed technical specifications for what’s actually being provided:
The pool’s structure and materials
The internal finishes
The filtration and lighting systems
And, most importantly, the planning documents that authorize the build
Then, consult an independent pool expert or geometra to review those details. It’s the only way to know whether the promised “turnkey” pool is truly what you expect and legally approved.
Independence Matters
Perhaps the most important piece of advice is this: don’t rely on professionals recommended by the selling agent.
Many agents will suggest a geometra, lawyer, or notary they’ve worked with before, and while these professionals may be competent, they’re not independent. Their ongoing business relationship with the agent could create a conflict of interest, even unintentionally.
Instead, seek out your own trusted experts, ideally ones who have no connection to the seller or agent. Their only loyalty will be to you, and that objectivity is priceless when navigating Italian property law.
